Pilates in the Haven Terms and Conditions
Please read through the terms and conditions thoroughly before signing up. By enrolling as a client of Pilates in the Haven you agree to the terms and conditions set out on The Pilates in the Haven website www.pilatesinthehaven.com.au
Studio Policies
- A maximum of 11 clients can attend a group class.
- Group classes run for a total of 50 minutes.
- Pilates in the Haven is a phone-free zone during class times. As a courtesy to others, please keep your phone on silent and in your bag. If you require your phone on you for an important reason, please advise the instructor prior to the class starting.
- Please let your instructor know prior to the class commencing if you have any injuries, concerns, or are pregnant.
- You must be at least 18 years of age to attend group classes unless they are attending with an adult or have prior consent from a legal guardian. The parent/ legal guardian assumes legal responsibility for performance of the minor’s obligations and is aware that the Pilates studio is an adult environment whereby some discussions may not be suitable for minors, under this Agreement.
- Children are not permitted in the studio during classes with the exception Mums and Bubs classes where bubs can come along as long as they are not mobile (can be in a pram or on a mat).
- Members must respect instructors, staff, and fellow members. Any conduct that disrupts the studio environment may result in membership suspension or termination.
Pregnant Clients
- Pilates in the Haven welcomes pregnant clients into the studio and a great way to stay healthy and active during pregnancy.
- Pregnant clients can attend all classes with the exception of Sweat
- Please inform instructors as soon as you are aware that you are pregnant so that we can advise you accordingly on any modifications required.
- If you are a new member and are pregnant, we ask that you please advise us when signing up or contact us first prior to booking into your first class.
Cancellation Policy – Membership
- You may cancel your membership any time after you have completed your 8 week minimum term. Cancellations require minimum 14 days notice prior to your next auto renewal date. Cancellation requests can be submitted via email to [email protected]
Cancellation Policy – Classes
Cancellations or rescheduling group classes must be done through the Momence App.
- Early Cancel – Cancellations or rescheduling group classes must be done at least 6 hours prior to the class start time to retain the class credit.
- Late Cancel
- If you cancel within 6 hours of the class start time you will forfeit your class credit
- If you hold any type of Thrive Membership (including Foundation and Presale) or an Intro Offer membership with Pilates in the Haven, a $10 cancellation fee will be charged for every late cancellation starting from the 2nd time you late cancel.
- No Show
- If you don’t cancel your class through Momence prior to the start time and you do not attend the class, you will forfeit your class credit
- If you hold any type of Thrive Membership (including Foundation and Presale) or an Intro Offer membership with Pilates in the Haven, a $10 cancellation fee will be charged for every no show starting from the 2nd time you no show.
- All cancellation charges will be charged automatically through Momence.
- Pilates in the Haven may cancel a class at any time and for any reason. You will be credited for any classes in this circumstance.
Suspensions
- Membership suspensions are allowed in increments of 1-week at a time and have a 1-week minimum suspension time. Suspension requests require 7 days notice prior to your next auto renewal date and must be submitted in writing via email to [email protected]
- Those on Foundation and Presale memberships
Membership Benefits
- All clients on any type of Nurture, Balanced or Elevate membership (including Foundation and Presale) are entitled to 1 credit for their ‘first’ late cancel each month (cancellations within 6 hours class start time). This can only be manually done, please email [email protected] so that we can pop the class credit back on to your account.
- All clients on any type of Thrive membership (including Foundation and Presale) are entitled to no cancellation fee charge for their ‘first’ late cancel each billing cycle (cancellations within 6 hours prior to class start time).
- All clients on any type of Thrive membership (including Foundation and Presale) are entitled to no cancellation fee charge for their ‘first’ no show each billing cycle.
- Minimum 8 week commitment for all memberships (4 auto renewals).
- 10% discount on socks and merchandise.
- Bring a NEW friend for free each month using the invite guest button on Momence.
- For those on any type of Nurture, Balanced and Elevate Memberships, your class credits can be used anytime within the billing cycle (ie Balanced Membership on 2 classes per week have 4 class credits to use within the fortnight). This gives you flexibility to use the classes when it suits you.
- For those on any type of Balanced or Elevate membership, an additional class on top of your weekly membership can be purchased at a reduced rate through the Momence App.
Bookings
- Class bookings are essential and managed through the Momence app and are subject to availability.
- Bookings can be made up to 30 days in advance.
- If a class is full, you can add yourself to the waitlist.
- Sessions cannot be used by anyone other than the person booked into the class. If someone other than the person booked in arrives to use the session, they will be turned away or asked to purchase their own session.
- Introductory offers will activate from the date when first used. Only one session per day can be booked using the introductory offer.
- Memberships will activate from the date of purchase.
- Class packs will be active from the date of purchase.
- Pilates in the Haven may change or substitute any instructor at any time without providing notice to clients.
Waitlist
- If a class is full, you can add yourself to the waitlist and you will be able to see what number on the waitlist you are. When a spot in the class becomes available, the system will automatically send an SMS to the first person on the waitlist, asking them to confirm if they want to be booked into the class. Each client has 30 minutes to confirm if they want to be booked into the class before the system moves to the next customer on the waitlist. The empty spot in the class will be reserved until the system has gone through everyone on the waitlist or until someone is booked into the class from the waitlist. The system won’t automatically text any customers after the waitlist cut-off. Customers who don’t have a phone number on file will be contacted via email.
- After the waitlist cut off, if a spot becomes available, everyone on the waitlist will be sent a SMS and the first person to respond will be booked into the class
Membership And Payments
All payments for services provided by Pilates in the Haven are due at the time of booking or as otherwise specified in your service agreement. We accept payment via credit cards, debit cards and direct debit.
- Your membership operates on a fortnightly auto-renewal basis. By signing up, you authorise Pilates in the Haven to charge your nominated payment method on a recurring basis via Stripe.
- All payments are processed securely via Stripe, our third-party payment processor. By submitting your payment information, you agree to Stripe’s Terms and Conditions and authorise recurring billing.
- Card Processing Fees:
A processing fee of 1.75% will be applied to all payments made via credit and debit cards. This fee covers the costs associated with processing card transactions. The fee will be automatically added to your total payment amount at checkout. - Alternative Payment Methods:
A processing fee of 1.3% will be applied to all payments made via direct debit. This fee covers the costs associated with processing direct debit transactions. The fee will be automatically added to your total payment amount at checkout. - If your deducted payment is unsuccessful, a fee of $5 will be charged to cover third party fees.
- Non successful payments will be automatically attempted 2 days after failed payment. If that then fails a 2nd re-run will be attempted 2 days after previous re-run and then a 3rd re-run 3 days after previous re-run.
- No refunds are provided for unused sessions or class packs.
- 5 Class Packs are valid for 3 months from the date of purchase, 10 class packs are valid for 6 months from the date of purchase and 20 & 50 packs are valid for 12 months from the date of purchase.
- There is a minimum sign-up period of 8 weeks on all memberships. 14 days written notice via email is required to cancel your membership and your membership will be cancelled 14 days from your request date. All payments scheduled during this processing time will continue to be deducted and you may continue using the membership until that payment expires. All membership cancellations need to be emailed in writing to [email protected]
- To avoid unintended payments or disputes, please ensure your payment method is up to date. If a dispute is raised without contacting us first, we reserve the right to restrict your account access until the issue is resolved.
- Our introductory offers are valid for one time only to new clients.
- Any changes to membership terms and pricing will be clearly communicated via email from Pilates in the Haven. Please ensure your email contact information is current. By signing up for a membership, you acknowledge that these occasional changes are part of this agreement.
- Anyone that has purchased Foundation memberships (Balanced, Elevate & Thrive) will enjoy a lifetime 20% discount on your membership price with a locked-in rate for the first three years.
Purchases
- All purchases are non-refundable and non-transferable between individuals. No refunds will be provided.
- No extensions are permitted to the specified expiry period.
- Our introductory offers are valid for one time only to new clients.
- All memberships will be deducted as per the auto renewal schedule outlined on your contract agreement.
- Payment must be made prior to booking. You must either have pre-purchased sessions on your account or pay at the time of booking via the Momence app or our website.
Amendments
- Any changes to membership terms and pricing will be clearly communicated via email from Pilates in the Haven. Please ensure your email contact information is current. By signing up for this membership, you acknowledge that these occasional changes are part of this agreement
Acceptance Of Terms
- By making a payment, you acknowledge and agree to these terms, including the additional card and direct debit processing fees.
Photography/Videoography
- From time-to-time classes offered by Pilates in the Haven may be photographed or filmed during class for the purpose of promotion of services on social media or our website. Please make us aware of any grounds, religious or otherwise that would prevent you from being able to or wish to be included in such content creation so that we can ensure that it is respected.
Personal Agreement
I agree that Pilates in the Haven Pty Ltd is not liable for personal injuries, loss of property, or other damages sustained while using the facilities. I understand that classes at Pilates in the Haven may be physically strenuous and I voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death and I assume all responsibility for any injuries or health conditions arising from participation. I confirm that I am in good health and have no medical conditions that would prevent me from safely participating in Reformer Pilates classes. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Pilates in the Haven or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
By booking into a class, you automatically agree to the above Privacy Policy and Terms & Conditions.
